1. Who we are and what these terms cover
DoneFy is a service operated by Torlien ("DoneFy", "we", "us", "our"). We design and deliver done-for-you websites and related setup services for cleaning businesses and similar small service providers ("you", "your", "the client"). These Terms of Use ("Terms") govern your access to and use of donefy.site (the "Site"), the ordering and briefing process, and the websites and services we deliver to you (together, the "Services"). By purchasing a plan, submitting a briefing, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. The company name on your card statement and receipts may appear as TORLIEN DONEFY.SITE. DoneFy is a brand operated by Torlien, and the charge is legitimate.
2. The plans and what is included
We offer the following plans. The features included in each are described on the Site at the time of purchase and are incorporated into these Terms by reference. Starter and Brand are one-time payments for the build and setup of your website. Business is a custom-scoped engagement, quoted individually after we speak with you. Each plan includes a defined set of change requests during the first 90 days after delivery. After those are used, or after the 90-day window, additional changes are billed per ticket at the rate shown on the Site (currently US$ 19 per change). Larger work, such as a new page or a redesign, may be quoted separately.
3. How our websites are built (important)
We build websites using modern rapid-development tools and platforms, including AI-assisted development environments. This lets us deliver a professional website quickly and at an accessible price. We make our best effort to deliver a secure, functional, and reliable product. Before and after delivery we run the security and quality tests available to us, and our work is reviewed and curated by experienced developers who address issues that arise. However, you acknowledge and agree that:
- no website, platform, or software is ever completely free of bugs, vulnerabilities, or downtime, regardless of how it is built;
- the Services are provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded by law;
- we do not guarantee uninterrupted availability, specific search-engine rankings, a specific number of customers or leads, or that the website will be error-free;
- we rely on third-party providers (see Section 9) whose availability and performance are outside our control.
If a defect or security issue is identified, we will make commercially reasonable efforts to correct it. Reporting a suspected issue to contato@donefy.site is the fastest way to have it addressed.
4. The briefing and your content
To build your website we ask you to complete a briefing and to upload materials such as business information, service details, photos, logos, and testimonials ("Your Content"). You represent and warrant that:
- the information you provide is accurate and complete;
- you own Your Content or have the rights and permissions necessary to use it, including any photos of people, properties, or third-party logos;
- Your Content does not infringe any third party's rights and does not violate any law;
- you have the consent of any individuals whose testimonials or personal data you provide.
You grant us a license to use, reproduce, adapt, and publish Your Content solely for the purpose of building, delivering, hosting, and supporting your website. You are solely responsible for Your Content and for the claims made on your website. We may refuse or stop work on any order that involves illegal content, fraud, infringement, or content we reasonably consider harmful or abusive. We may also feature your delivered website as an example of our work in our portfolio unless you ask us in writing not to.
5. Delivery timeline
We aim to deliver Starter websites within 72 hours and Brand websites within approximately 96 hours after we receive a complete briefing and confirmed payment. Business timelines are agreed individually. These timelines depend on you providing complete and accurate information and any content we request. Delays caused by incomplete briefings, slow feedback, missing materials, third-party verification steps (for example Google Business Profile), or third-party outages do not count toward our delivery estimates.
6. Payment
Prices are shown on the Site in US dollars and are charged through our payment processor. By purchasing, you authorize the charge for the selected plan and any add-ons such as additional change tickets. Payment is processed by Stripe. We do not store your full card details. For plans purchased as a one-time payment, the fee covers the build and setup as described for that plan. Chargebacks made in bad faith, after the Services have been delivered, may be disputed by us with the evidence of your order and briefing.
7. Domain, hosting, email, and year-two costs
Domain: where a domain is registered as part of your plan, it is registered in your name. You own it. During the first year the registration cost is on us. From the second year onward, you are responsible for renewing the domain at cost (typically US$ 12 to US$ 20 per year).
Hosting and email: the first year of hosting and professional email is included. From the second year onward, hosting is available from US$ 10 per month, and you are responsible for those ongoing costs if you want the website and email to remain active. If you stop paying any ongoing amount that is due from year two, the website and email may be suspended or taken offline until payment resumes. Your domain remains in your name.
Booking and CRM tools: from the Brand plan, we can set up a third-party scheduling or CRM tool (such as Housecall Pro, Launch27, or BookingKoala). The subscription to that tool is contracted and paid by you, in your name. We configure it; we are not responsible for the pricing, availability, or performance of those third-party tools.
8. Ownership and handoff
Once a website is fully paid and delivered, and subject to any ongoing hosting arrangement, the website content and the domain are yours. If you choose to leave, we will provide reasonable assistance to hand over your domain and site so you can host it elsewhere. We retain ownership of any generic templates, components, and know-how used across multiple clients; you receive a license to use them as part of your delivered website.
9. Third-party services
The Services rely on third-party providers, including but not limited to Stripe (payments), Resend (transactional email), Supabase (data and file storage), Cloudflare (bot protection), Hostinger (domain and hosting), Google (search and business tools), and the booking or CRM tool you choose. Your use of the delivered website and its features may also be subject to those providers' own terms. We are not responsible for the acts, omissions, availability, or policies of third-party providers.
10. Acceptable use
You agree not to use the Services to:
- break any applicable law or regulation;
- upload malware, attempt to gain unauthorized access, or interfere with the security or operation of the Site or the Services;
- submit false, fraudulent, infringing, or harmful content;
- or abuse the ordering, briefing, or contact forms, including through automated or bulk submissions.
We use rate limiting and bot-protection measures and may block or remove access to prevent abuse.
11. Limitation of liability
To the maximum extent permitted by law:
- the Services are provided "as is" and "as available";
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities;
- and our total aggregate liability arising out of or relating to the Services is limited to the total amount you actually paid us for the specific plan giving rise to the claim in the twelve months before the event that caused the liability.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless DoneFy and Torlien from any claim, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the delivered website, your violation of these Terms, or your violation of any law or third-party right.
13. Cancellation and refunds
Because the Services involve custom work delivered quickly, refund eligibility depends on the stage of the work at the time of your request. If you cancel before we begin building, we will refund amounts paid, less any third-party costs already incurred on your behalf (such as a registered domain). Once the build has started or been delivered, fees for completed work are generally non-refundable. Contact contato@donefy.site to discuss any cancellation.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Material changes will be posted on the Site. Your continued use of the Services after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Torlien is established, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply.
